QUEBEC'S TOP COURT RULES SECULARISM LAW IS CONSTITUTIONAL, APPEAL TO SUPREME COURT LIKELY

Quebec’s secularism law, Bill 21, has been ruled constitutional and the province’s top court at the same time also overturned a lower court ruling that exempted English school boards from it.

 

 

The Court of Appeal’s decision upholds much of a 2021 Superior Court ruling that said the law’s use of the notwithstanding clause overrode infringements of fundamental rights.

The law, that’s been on the books for five-years, prevents civil servants in positions of authority; such as teachers, judges and police officers, from wearing religious symbols while at work.

Sounds as if this is going to the Supreme Court since prior to today’s ruling both the governments and the law’s critics said they would probably appeal.
