Former U.S. President Donald Trump does not have immunity from criminal charges for actions he took as president. That’s the official ruling of a U.S. judge, who rejected Trump’s bid to have the case tossed out against him by Special Counsel Jack Smith. Trump is accused of unlawfully attempting to overturn his 2020 election loss to Democrat Joe Biden.

U.S. District Judge Tanya Chutkan found no legal basis for concluding that presidents cannot face criminal charges once they are no longer in office.

Trump is the frontrunner for the Republican nomination and some polls indicate he would beat Biden, if an election was held now. The only real issue at this point is whether or not he’ll legally be allowed to run for president next year.

The judge also rejected Trump’s argument that the charges violate his free speech rights under the U.S. Constitution’s First Amendment.
