DEVELOPER WANTS MARKHAM PROPERTY REMOVED FROM GREENBELT NOT TO BE PART OF LANDS TO BE RETURNED

The owner of one of 15 parcels of land removed from the Greenbelt by the Ford government is asking the province to exclude his 37-acres in Markham from the bill to return that’s to return all of them to the protected area.

 

 

Minotar Holdings has long felt the Markham property was incorrectly included in the Greenbelt in the first place.

The developer sued the government over it for $120-million.

Both sides agreed removing that property’s protective designation would settle the lawsuit.

But then last month the government introduced legislation to return all removed lands to the Greenbelt and prevent affected developers from seeking remedies along with a clause retroactively voiding the settlement between the Ford Tories and Minotar.

Lawyers for the developer says if the bill passes as is, they’re looking at whether they could pursue a judicial review or constitutional challenge.

A spokesperson for the housing minister indicted the province is not considering an amendment.
