9-MONTHS IN JAIL FOR TORONTO POLICE OFFICER CONVICTED IN BEATING OF YOUNG BLACK MAN

The Toronto police constable, convicted of assault in the brutal beating of Dafonte Miller, has been sentenced to nine-months behind bars.
(Const. Michael Theriault, Christian Theriault, Dafonte Miller)
Const. Michael Theriault will also be under 12 months probation and will have a five-years weapons prohibition.
The officer, off-duty at the time, and his brother, Christian, were charged with aggravated assault and obstruction of justice in the December 2016 incident in Whitby.
Miller, then 19, was beaten with a metal pipe and left with a ruptured eye and other injuries.
The defence said the brothers wanted to arrest Miller after catching and some friends stealing from the family truck, but feared for their lives after Miller confronted them with the pipe and acted in self-defence..
Christian Theriault was acquitted of all charges.
The prosecution sought a jail term of 12 to 15 months for Const. Theriault.
The defence asked for an absolute discharge or suspended sentence, saying the crime was not racially motivated and that the sentence should not be seen as a mechanism to address the issue of systemic racism in policing.
