SUPREME COURT OF CANADA WON'T HEAR TORONTO CITY COUNCILLOR'S BID TO KEEP SEAT

Three strikes and he’s out.
The Supreme Court of Canada will not hear an appeal by a Toronto city councillor who was fighting his removal from office.
The decision means Jim Karygiannis has lost his seat for Ward 22 Scarborough-Agincourt.
He exceeded a spending limit during the last municipal election, and under Ontario’s Municipal Act, such a violation carries a penalty of an automatic forfeiture of office.
However, an Ontario Superior Court justice allowed Karygiannis to keep his seat, deciding the error was inadvertently and that he had not tried to hide anything.
The province’s highest court then set aside the lower court decision, saying there was no jurisdiction to provide relief from forfeiture.
The Supreme Court, as usual, gave no reason for refusing to hear the appeal.
In a statement, the city of Toronto says the ruling means Karygiannis is no longer a councillor.
A report will now go to city council September 30 with the option to either fill the vacancy by appointment or call a by-election.
