One of the two men convicted of plotting to derail a passenger train between New York and Toronto is being treated for schizophrenia and now wants to appeal his life sentence.

Chiheb Esseghaier and accomplice Raed Jaser were found guilty in 2015 of conspiring to commit murder for the benefit of, at the direction of or in association with a terrorist group, as well as other charges.

Esseghaier’s court appointed lawyer says he will ask the Court of Appeal of Ontario to give him more time to file a notice of appeal against his life sentence.

Erin Dann says since filing his original notice of appeal over his conviction, Esseghaier’s been treated for mental health issues and ”now understands the severity of the sentence imposed.”

Concerns about his mental state were raised during the sentencing phase of his trial.

Esseghaier and Jaser were sentenced to life in prison with no chance of parole until 2023.

Jaser’s also appealing his conviction.
