A 76 year old Toronto man has been convicted of second degree murder in the death of a fellow resident at The Wexford Residence on Lawrence Avenue East. Peter Brooks has been found not guilty of a charge of attempted murder in the attack of a second female resident of the long term care home.
The jury deliberated for 10 hours over what responsibility Peter Brooks had for the attacks on two women at the home in March of 2013.
The verdicts were announced last night at the University Avenue Courthouse.
Brooks had pleaded not guilty to first-degree murder in the death of 72-year-old Jocelyn Dickson.
His lawyer argued Brooks had dementia and was unable to appreciate the nature of his actions, but the prosecution contended that Brooks was not delusional and knew his actions were wrong.
Second-degree murder carries an automatic life sentence, but the court has the discretion to set parole eligibility at anywhere from 10 to 25 years.
Sentencing will take place January 13th.
