A Toronto police officer sentenced to six years for the attempted murder of 18 year old Sammy Yatim on a streetcar three years ago has been granted bail while he appeals the conviction.

The appeal judge, Justice Eileen Gillese, ruled this morning that James Forcillo poses no risk to the public of reoffending.

At sentencing yesterday, Justice Edward Then said Constable Forcillo abused his authority in a way that undermines public trust in law enforcement and the justice system.

Shortly after the sentencing decision was read, police Chief Mark Saunders announced the 33 year old father of two would be suspended without pay.

The teenager’s death in 2013, which was caught on smartphone videos, sparked protests and strained public faith in the country’s largest municipal police force.

The appeal case will likely be heard in the spring of 2017.
