A senior bureaucrat who allegedly played a prime role in the destruction of records in former Premier Dalton McGuinty’s office – no longer has responsibility for overseeing Ontario’s archival records.

A published report states that David Nicholl will be losing his job as Acting Deputy Minister of Government Services – according to a source with knowledge of the matter.

Associate Deputy Minister of The Treasury board Greg Orencsak is said to be expected to replace Nicholl.

According to a police affidavit used to obtain a search warrent – it was Nicholl who gave the go-ahead for McGuinty’s former Chief of Staff, David Livingston – to erase computer hard drives in the Premier’s office.

His alleged role is contained in police documents unsealed by an Ottawa judge – after media organizations fought for their release.

Police allege Livingston committed a criminal breach of trust – by allowing a non-government professional, Peter Faist, to gain unrestricted access to documents on 24 hard drives in the Premier’s office.

The allegations have not been tested in court and Livingston has not been charged.

Nicholl is not under investigation at this time.
