A lawyer representing Senator Mike Duffy says his client is in compliance with senate rules on what constitutes a permanent residence.
Donald Bayne says senators who want to suspend Duffy from the upper chamber without pay are acting like a mob that’s demanding a sentence before a trial.
A Conservative Party proposal would punish Duffy, Pamela Wallin and Patrick Brazeau for improperly claiming expenses.
Duffy has billed taxpayers for more than $30,000 in housing expenses since September, 2010.
He has said his house in Ottawa is his secondary residence while his cottage in Cavendish, P-E-I, is his primary dwelling.
Duffy, announced Thursday morning that he is taking a medical leave of absence preempting his suspension.
That means he will likely be able to continue receiving his $135,000 annual salary.
Meanwhile Senator, Wallin is threatening legal action against the move to suspend her without pay.
