Rob Ford remains the Mayor of the City of Toronto.  As we reported in breaking news shortly after 10:30am on both The New AM 740 and Classical 96.3FM, Ford has won his court battle to keep his job.

A Divisional court panel this morning struck down a previous ruling that Rob Ford should be dismissed from office for violating the Municipal Conflict of Interest Act.

The three-judge panel agreed with Ford’s lawyers, who had argued the previous ruling was legally flawed.  In fact, the three judges concluded that the application judge erred in finding Mr. Ford contravened the municipal conflict of interest act and accordingly they say, they are allowing the appeal.  After hearing the news, Mayor Ford left his lawyer’s office and got into his vehicle to drive himself to City Hall where he will give a statement at 11:30.

Councillor Joe Mihevic has been a strong opponent of Mayor Ford.  “For those who thought that he would lose, well obviously he didn’t.  And so, we just have to get back to business, back to running this city. My hope is that the mayor is chastened by this new lease on life that he has.  That he has a different approach to governing that he has until this time. ”

Others on council have been supporters of Mayor Ford, including James Pasternak.  “Well this has been a relief, this whole saga has just zapped the oxygen out of City Hall.  It’s been a major distraction and drain.  But it’s over with.  The appeal panel has ruled and now it’s getting on with governing the city.”

In November, an Ontario Superior justice ordered Ford removed as mayor for taking part in a council vote that he repay $3,150 raised for his private football foundation.

The ruling was put on hold pending today’s decision which has come out in Rob Ford’s favour.

Despite today’s legal win, Rob Ford’s woes are not done. An audit of his campaign expenses is pending.
