SCOC: CITIES CAN BE SUED OVER SNOW REMOVAL RESULTING IN INJURIES

It was unanimous.
The Supreme Court of Canada’s seven justices all agree municipal snow removal is not immune from negligence and liability claims.
The case at the centre of the decision is a lawsuit against the city of Nelson, B.C. by a woman who hurt her leg climbing over a snowbank in 2015.
Taryn Joy Marchi lost the initial suit, but B.C.’s Court of Appeal overturned the ruling and the city took it to the Supreme Court.
The then 28-year-old nurse seriously hurt her leg as she tried to climb over a snowbank to get to the sidewalk.
The fact the case will now proceed is significant because it could impact other Canadian cities.
The attorneys-general for Canada, Ontario, Alberta, B.C. were all interveners in the case, as was the City of Toronto and city of Abbotsford.
