PUB OWNER SUES LCBO AND BEER STORE OVER DEAL TO RESTRICT PACK SIZES

Only The Beer Store can sell you a case of 24; not the LCBO.

And that`s prompted a Burlington pub owner to  launch a potential class-action lawsuit against the LCBO and The Beer store after hearing customers and colleagues complain.

In a pact that goes back14 years, the LCBO agreed to sell only six-packs of beer — not 12 or 24 packs — to consumers.  It also agreed not to sell cases of 24 to restaurants and bars.   Only The Beer Store can sell the larger packs, which have lower per-unit prices.

The deal means The Beer Store profits by limiting the LCBO from competing on products, pricing and territory.

The lawsuit seeks 1.4 billion dollars in general damages and 5 million dollars in punitive and exemplary damages on behalf of David Hughes, his Burlington pub “The Poacher,“ and other persons in Canada who are similarly situated.
